1. General
1.1 This website is operated by Tizzalicious. Throughout the site, the terms “we”, “us” and “our” refer to Tizzalicious. These terms and conditions apply to all products and services offered by Tizzalicious.
1.2 By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply  to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

2. Delivery
2.1 Tizzalicious guarantees delivery of items in stock.
2.2 If Tizzalicious can't deliver within 30 days, the customer will receive notification, and will be able to cancel their order. A full refund will be issued.
2.3 If for any reason the customer fails to accept delivery of any of the goods when they are ready for delivery, or if the company is unable to deliver the goods on time because the customer has not provided appropriate instructions, documents, license or authorizations the Goods shall be deemed to have been delivered
2.4  Any specified delivery dates are estimates only and do not represent a promise by Tizzalicious to deliver products at a date certain.

3. Prices
3.1 Prices will not be raised during sales, except as required by law.
3.2 Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to pricing, promotions, offers, and product shipping charges. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
3.3 All prices are in EURO's en incl. 21% VAT. VAT will automatically be deducted for customers who are VAT exempt.

4. Refunds
4.1 The customer is entitled to cancel their order for any reason until, but no later than the end of the 14th day after the day of receipt of the Goods. The customer should cancel goods purchased from us by sending a notice of cancellation by e-mail or by filling out our returns form. The customer will need to prove that the items have been returned. On cancellation of an order, the customer must return the goods to us in their original condition and undamaged. When you cancelling an order, the customer will have to pay the carriage costs for returning the goods to us, unless we have not been able to supply the goods as ordered or if the goods arrived damaged. The customer must take reasonable care to ensure that the goods are properly packaged so that they will not be damaged whilst in transit. Tizzalicious will issue a refund for the goods and basic shipping costs within 7 days upon receipt of the returned goods. Extra shipping options are non refundable.
4.2 Servives are not refundable.
4.3 The following are not eligible for refunds:

    - Extra shipping options
    - Custom made items
    - Gift cards

5. Privacy Policy
5.1 We collect information from you when you place an order or subscribe to our newsletter.
When ordering or registering on our site, as appropriate, you may be asked to enter your: name, e-mail address, mailing address, phone number or credit card information. You may, however, visit our site anonymously.
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.
5.2 Because we value your privacy we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. We therefore will not distribute your personal information to outside parties without your consent.
5.3 All e-mails sent through our mailinglist include instructions to unsubscribe.

6. Warranty
6.1 Tizzalcious warrants that, during the warranty period, the product will, with normal use and service, be free from faulty parts, manufacture or workmanship.
6.2 The warranty period is 3 months. Tizzalicious is echter nimmer verantwoordelijk voor de uiteindelijke geschiktheid van de zaken voor elke individuele toepassing door de afnemer, noch voor eventuele adviezen t.a.v. het gebruik of de toepassing van de zaken.
6.3 In case of delivery of a faulty or damaged product, the customer should send a notice by e-mail or by filling out our returns form within 2 months of delivery. The customer will need to prove that the items have been returned. The customer must take reasonable care to ensure that the goods are properly packaged so that they will not be damaged further whilst in transit.
6.4 Tizzalicious will issue a refund for the goods and shipping costs within 7 days upon receipt of the returned goods. Tizzalicious is not responsible for any damages as a result of the fault product, including loss of profit.
6.5 The warranty does not apply where damage is caused by other factors, including without limitation:
(a) normal wear and tear; (b) abuse, mishandling, accidents (c) exposure to liquid (excluding water in the case of waterproof products) (d) servicing or modification of the product other than by Tizzalicious.

7. Sales & Promotions
7.1 Tizzalicious reserves the right to change, amend, or end each of the promotions at any time and without prior announcement.
7.2 Sales and promotions are only valid when confirmed in writing.
7.3 Sales and promotions are not automatically valid on re-orders.
7.5 Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
7.6 Changes or additions to sales and promotions are only valid when confirmed in writing.

8. Contract
8.1 A contract between Tizzalicious and the customer is valid once Tizzalicious has approced the order.
8.2 We reserve the right to refuse any order you place with us.

9. Images and specifications
9.1 We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

10. Force Majuere
10.1 We shall not be liable to you or be deemed to be in breach of contract by reason of any delay in performing or any failure to perform any of our obligations in respect of the goods or services, if the delay or failure was due to any cause beyond our reasonable control.
10.Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond our reasonable control: act of God, explosion, flood, tempest, fire or accident; war, threat of war, sabotage, insurrection, civil disturbance or requisition; acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority; import or export regulations or embargoes; strikes, lock-outs or other industrial actions or trade disputes (whether involving our employees or of a third party); difficulty in obtaining materials, labour or machinery; and power failure or breakdown in machinery.
10.3 If we are unable to provide you with your goods within a reasonable time due to circumstances outside our control, we shall either agree a new timescale with you for the delivery of the goods or either of us may decide to terminate the order in which case we will return any prepayments that you have made in full. Tizzalicious will in no case have to pay fines or compensation for loss of profit or any other reason.
10.4 If part of the order has been delivered, this part of the order will be treated and billed as a separate contract.

11. Responsibility
11.1 Tizzalicious is not resposible for any accidents that might happen while using or wearing our products.

12. Governing Law
12.1 These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Netherlands.
